The End of the Pathology Grandfather: Strategies for Negotiating TC Payments with Hospitals

With the June 30 expiration of the technical component grandfather protection, laboratories that provide pathology services to hospitals will now have to negotiate to receive payment directly from the hospitals.
The grandfather protection, which had been in place since 1999, allowed certain labs to bill Medicare directly for the technical component (TC) of pathology services provided to hospital inpatients and outpatients. While Congress in the past has extended the protection year after year, lawmakers this year extended it until only June 30. Effective July 1, labs will no longer be able to bill Medicare for pathology services provided to hospitals.
For inpatient services, no additional payment will be received by the hospital because the TC is considered to be included in the DRG payment. For outpatient services, the TC will be billed separately and paid under the outpatient prospective payment system. In either case, most labs are likely to take a significant cut in payment they receive for the pathology TC.
