Clinical laboratories have increasingly become the targets of government enforcement actions in recent years. The U.S. Department of Health and Human Services Office of Inspector General and the Department of Justice (DOJ) have prosecuted dozens of clinical laboratories and their owners for several alleged violations. These violations include kickbacks to physicians and telemarketers, billing for medically unnecessary services (particularly with respect to genetic, respiratory pathogen, and toxicology testing), inappropriately bundling tests, and waiving patient copayments and coinsurance. With such a focus on fraud and abuse, earlier this year, the DOJ updated its detailed guidance on how it evaluates the sufficiency of a corporate compliance program and how it will evaluate personal corporate responsibility.
